1. Welcome to Koongo!

NoStress Commerce s.r.o. (hereinafter referred to as the ‘Koongo’) takes the privacy of its visitors and customers to the website (hereinafter referred to as the ‘Website’) and hosted application (hereinafter referred to as the ‘Application’) very seriously. On this page, Koongo addresses what information is collected from you (whether online or offline) and how that information is used.

This document sets out the principles and procedures for the processing of personal data and rights, in accordance with Regulation (EU) 2016/679 of the European Parliament, so-called "GDPR" and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (hereafter "the Regulation"), and Act No. 480/2004 Coll., on Certain Information Society Services, as amended.

By accessing or using the Website or Application, you acknowledge that you have read, understood and accept this privacy policy and its terms. If you do not agree with our data protection regulations, please do not register for this service.

2. Authorized person for the protection of personal data

Jiri Zahradka, CEO of Koongo, (hereinafter referred to as the "Data Administrator") is the person that determines the purpose and means of the personal data processing. He is responsible for the personal data handling. For all matters concerning the protection of personal data please contact the Data Administrator at

3. The principle of processing personal data

The Data Administrator processes personal data in the compliance with the following principles arising from the Regulation:

  • legality, correctness and transparency of processing;
  • purpose limitation - collection only for certain, expressly expressed and legitimate purposes;
  • minimization of data - adequacy, relevance and limitation of processing to the extent necessary in relation to the purpose;
  • accuracy and timeliness - the Data Administrator shall take all reasonable steps to ensure that personal data which are inaccurate, taking into account the purposes for which they are processed, are erased or corrected without delay;
  • limited storage - personal data shall be stored in a form which permits the identification of data subjects for no longer than is necessary for the purposes for which they are processed provided that the appropriate technical and organizational measures required by the existing legislation are in place to guarantee the rights and freedoms of the data subject ;
  • integrity and confidentiality - personal data are processed in a manner that ensures their proper security, including their protection through appropriate technical or organizational measures against unauthorized or unlawful processing and against accidental loss, destruction or damage

4. Customer rights

The customer is entitled to the following information:

  • information about the purposes of personal data processing
  • information about personal data processing itself
  • information about subjects who are processing the personal data
  • information about the planned time period for which personal data will be stored or, if it is not possible to determine it, the criteria used to determine that time estimated for the legitimate interest of the trustee or third party in case the processing is based on this reason
  • information about the source from which the personal data originated

Customer has the right to:

(a) access personal data and rectification, erasure or limitation of the personal data processing;

(b) object to such processing;

(c) lodge a complaint with the supervisory authority;

(d) at any time revoke consent to the processing of personal data with future effects;

(e) obtain a confirmation from the Data Administrator that his/her personal data is or is not processed;

(f) to correct the inaccurate personal data relating to him/her without undue delay. Taking into account the purposes of processing, the data subject has the right to supplement incomplete personal data

g) ask the Data Administrator for personal data removal. The Data Administrator is obliged to delete the personal data without undue delay in compliance with the reasons stated in the Regulation:

  • personal data are not necessary for the purposes for which they were collected or otherwise processed;
  • customer withdraws the consent to the personal data processing and there is no further legal title for processing;
  • the customer objects to processing and there are no overriding grounds for further processing;
  • personal data have been processed unlawfully;
  • personal data must be erased in order to comply with a legal obligation laid down by the EU or national legislation applicable to the Data Administrator;
  • personal data were gathered in connection with the provision of information society services. Details and exceptions to this right are governed by the Regulation;

(h) the Data Administrator limits the processing of the persona data in any of the following cases: (a) the data subject denies the accuracy of the personal data for the time necessary to verify the accuracy of the personal data; (b) the processing is unlawful and the data subject refuses the deletion of personal data and instead requests restrictions on its use; (c) the Data Administrator no longer needs personal data for processing but the data subject is required to identify, exercise or defend legal claims; (d) the data subject has objected to processing until it has been ascertained whether the legitimate reasons for the controller outweigh the legitimate reasons for the data subject;

5. Information Collected

To better serve Website visitors and Application customers, and to enable the operation of the services offered, Koongo collects two basic types of information from users:

5.1. Personally Identifiable Information

This information personally identifies one individual from another, and except as stated in this Privacy Policy, is voluntarily provided to us by visitors and customers.

 5.2. Aggregate User and Tracking Information

This information provides insights on how customers and visitors use the Website, Application and other Koongo products. This data is anonymous in nature and does not contain any personally identifiable information. This information is used to ensure that the Website, email messages and marketing efforts continue to appeal to users.

6. Voluntary Information

Except as stated in this Privacy Policy, Koongo only collects personally identifiable information that you voluntarily provide to us. Examples include, among other information, your name, email address, postal address, business id, Application user name, password, phone number, authentication certificates, social networking identifiers and communication platforms (e.g. Skype). Koongo only requires personally identifiable information from you when it is needed for registration or placing orders on the Website.

7. Other information Koongo collects

When you visit the Website, some information about your visit may be automatically collected using cookies, log analysis software and other aggregate tracking technologies.

7.2. Log File Analysis

Koongo also collects information from your computer each time you visit the Website using log file analysis software. Information measured, analyzed and collected in this manner may include but is not limited to: your IP address, operating system, platform information, date and time of your click stream behavior, cookie information, session information (includes: page interaction information, browser interaction information, page response times, length of visits to individual pages, and download errors) and web browser software.

Information collected on how you use the Website does not include personally identifiable information. Though some personally identifiable information may be collected in this process, the information collected is not used to track an individual’s use through the Website.

Any comments or questions you submit through Koongo support desk are recorded as well. By using Koongo services, you are giving Koongo permission to use and store such information consistent with this privacy policy.

8. Use of Collected Information

Koongo will not sell, exchange or otherwise distribute your personally identifiable information without your consent, except to the extent required by law, in accordance with your instructions, or as identified in this privacy policy.

9. Personally Identifiable Information

Koongo may use your information, including personally identifiable information, for business purposes including, without limitation, the following:

1. To create your account with Koongo.

2. To update your account with any information received from you or from third-party sources about you.

3. To operate its Service, provide statistic to you or include this data in public, aggregated reports about the performance and activities of all Koongo customers.

4. Koongo sometimes contracts with other companies and individuals to perform functions or services on its behalf, such as hosting the Website, sending email messages, administering surveys, delivering packages, and processing credit card orders. Such third parties may have access to personally identifiable information, such as email addresses, street addresses, and credit card numbers, needed to perform their functions, but are restricted from using it for purposes other than providing services for Koongo.

5. Koongo may preserve and has the right to disclose any information about you or your use of the Website without your prior permission if Koongo has a good faith belief that such action is necessary to:
protect and defend the rights, property or safety of Koongo or its affiliates, other users of the Website, or the public;
enforce the Terms and Conditions for the Website;
respond to claims that any content violates the rights of third parties; or
resolve credit card disputes or for fraud protection.

6. Koongo may also disclose information as Koongo deems necessary to satisfy any applicable law, regulation, legal process or governmental request.

7. Koongo may share any information you submit when Koongo has your consent to do so, or when Koongo needs to share it in order to provide the information or service you requested.

8. To improve the quality of your visit to the Website and affiliated Websites and services.

Personal data will be processed to identify the parties and performance of the contract and to record the contract and the future eventual application and defense of the rights and obligations of the parties. Such processing is permitted by Article 6 (1) (a). (b) and (f) of the Regulation.

Personal data will be processed for the duration of the contractual relationship and further to the extent necessary for a period of 10 years from the termination of the contractual relationship, unless otherwise required by the law to retain the contractual documentation for a longer period.

According to the Regulation, the customer is entitled to:

  • ask the Data Administrator for information about what personal data processed,
  • request access to and update or fix these data, or require processing restrictions, 
  • request the deletion of such personal data,
  • the portability of data and the right to request a copy of the processed personal data,
  • file a complaint with the supervised authority and the right to effective judicial protection if it considers that its rights under the Regulation have been breached as a result of the processing of its personal data in violation of the Regulation.

The processing of personal data is carried out by the Data Administrator, but the personal data can be processed also by these processors:

  • accounting services - Ing. Lenka Lischková, ICO 87269431, address Ke Hradu 130, 471 52, Sloup v Čechách, Czech Republic;

  • email client provider;
  • MailChimp software;
  • Zapier software
  • Payment providers
    • the relevant bank institution, Fio banka, a.s., Millennium Plaza, V Celnici 10, 117 21, Praha 1
    • PayPal, 2211 North First StreetSan Jose, California 95131
    • Ingenico Group S.A., 28/32 boulevard de Grenelle, 75015, Paris, France

  • Alternatively, other providers of processing software, services, and applications that are currently not used by the Data Administrator.

10. Non-personally Identifiable Information

Koongo may use your non-personally identifiable information it collects during your visit to the Website, during your interaction with Koongo's emails or during your interaction with Koongo's third-party marketing efforts for other purposes including, without limitation, the following:

1. To better monitor in aggregate the effectiveness of Koongo's online and offline advertising and marketing campaigns.

2. To better monitor in aggregate how visitors and customers are using the Website.

3. To ensure that the Website and emails continue to provide relevant content that is interesting and useful to users.

4. To uncover and diagnose problems with the Website and Koongo's servers.

5. For day-to-day system administration needs.

11. What You Get From Koongo

Koongo believes that honest and clear communications with customers and users is a key part of a great experience. All of Koongo's email communications contain information on how to unsubscribe, and Koongo honors all requests as quickly as possible. Below are examples (without limitation) of communications you may receive from Koongo:

11.1. Registration Email Messages

When you join for an account, you will receive an email confirming your registration (as applicable). The email message will contain your name, the email address you provided and your Koongo sign-in information.

11.2. Marketing or Promotional Emails

In case the Data Administrator processes the customer's personal data for other purposes that can not be subordinated to the legitimate interest or performance of the contract, he can only do so on the basis of a valid consent to the processing of personal data by the customer, which is an expression of free will of the customer a specific title for such personal data handling.

The customer needs to explicitly agree with the personal data processing. The email address will be processed for inclusion in the business messaging database.

Personal data will be processed for 10 years from the date of your consent, unless you extend this period.

You can accept consent at any time, for example, by sending a letter, email or a click to a link in your business message. Withdrawal of consent will result in the suspension of commercial communications.

12. Answering Inquiries

If you send Koongo a question or suggestion, Koongo may use your email address or telephone number or to respond to you.

13. Koongo Products – Other Websites

Koongo does not share personally identifiable information with business partners who display or offer Koongo products or services on their Websites.

14. Protection

Koongo understands that the safety of your personal information is extremely important to you. That is why Koongo uses both electronic and other measures to keep your information protected from unauthorized access. We use industry-standard Secure Socket Layer (SSL) software to protect the transmission of information that you submit to the Website. This software encrypts the information that you input.

While we use current industry standard procedures to protect your privacy, unfortunately, no data transmission or storage security can be guaranteed 100% of the time. In addition, third parties may unlawfully intercept or obtain information from the Website. We do not promise that your personally identifiable information will remain private in such cases.

The processing of personal data may be processed by the processors solely on the basis of a contract for the processing of personal data, with the guarantees of organizational and technical security of these data and with the definition of the purpose of the processing, and the processors may not use the data for other purposes.

15. About This Policy

The Koongo privacy policy was posted on the date set forth above. Koongo reserves the right to change, alter or modify this policy for any reason at any time. When Koongo does so, changes in Koongo's privacy policy will be posted on the Website and will be effective after a 30 day period from the day the changes have been published. If you are a regular visitor or subscriber to this Website, Koongo recommends that you check this privacy policy on a regular basis. It is assumed that you agree to all the changes if you continue using our service after expiry of the period.

If you do not agree to the revised data protection regulations, you can deactivate your account at any time.

Koongo Website may include links to other Websites whose privacy policies Koongo does not control. Once you leave the Website, use of any information you provide is governed by the privacy policy of the operator of the Website you are visiting. That policy may differ from Koongo's policy and is not covered within this privacy policy.

17. Choosing Not to Provide, Accessing and Updating your Information

The Website allows you to choose not to provide personally identifiable information. However, if you opt not to disclose information to us, you may not be able to make a purchase or take advantage of certain features of the Website.
Customers may view and change their personally identifiable information by logging into their password-protected account. Once logged in, click the ‘Edit Account’ link. From here a customer may update their personal information, password, billing, and subscription information, including the ability to close their account.

It may take a reasonable period of time to respond to any request to cancel or modify an account. If you request the deletion or modification of your personal information maintained by Koongo, such information may be retained for a period of time in Koongo's backup systems as a precaution against system failures. Some information may be retained for longer periods as required by law, contract or auditing requirements.

18. Personal data handling termination

The Data Administrator terminates the handling of customer data after the termination of the contractual relationship, after the expiry of the period specified in the consent to the processing of personal data or after forfeiture of the legitimate reasons for the archiving of personal data.

19. Processing method

Personal data are processed automatically and manually and can be  available to the Data Administrator's employees. Personal data can be available also to the processors with whom the Data Administrator has entered into a contract for the processing of personal data if this is necessary for the fulfillment of their duties. Personal data can be available to another person under the conditions which are compliant with the Act and the Regulation.

20. Security breach

In the event of a breach of security of data handling or data leakage, the Data Administrator shall promptly inform the Customer and the Office for Personal Data Protection within 24 hours.
